    I fully accept that there are political postitions that I disagreee with that are valid diferences of opinion.

    Scalia has sided with the liberals on all of the non-unanimous Fourth Amendment cases this term. It's on legalistic/technical/precedence grounds rather than any "liberal" sympathy for Fourth Amendment rights as such.

    That said, I kind of agree with Yancy. The government's argument that this is like fingerprinting seems reasonable to me.
